User Terms and Conditions

Article 1 (Establishment and Agreement of Terms and Conditions)

BeA, Inc. (hereinafter referred to as ”the Company") has established the following terms of use (hereinafter referred to as "these Terms") for the use of all of the services provided by BeA, Inc. (hereinafter referred to as "the Company") under the service name "JOYJAPAN 揪愛日本", (hereinafter referred to as "the Service"). Users of the Services ("Users") shall agree to these Terms of Use before using the Services.

2. The detailed contents, terms of use, etc. of the Service shall be subject to these Terms and Conditions (hereinafter together with these Terms and Conditions, collectively referred to as the "Terms and Conditions, etc."), which shall be separately formulated by the Company.

3. The Company may review the details of the Service, these Terms and Conditions, etc. from time to time.

Article 2 (Purpose of the Service)

The service is a travel information medium based on the concept of "Unknown x Charm x Travel". The main purpose is to publish information based on the above concept provided and published by local governments and users, and to allow other users to view it.

Article 3 (Content of Messages)

The Company does not warrant the accuracy, validity, legality, appropriateness of purpose, or any other matter with respect to the content of the information published, viewed, or posted on the Service, or that users may suffer damages in connection with such information. No liability is assumed under any circumstances.

2. All or part of the information provided in the Service may be changed, interrupted or discontinued without prior notice to the user.

Article 4 (Obligations in relation to the Service)

Our liability in respect of the Service is limited to the provision of the Service and we shall not be liable for anything other than as set out in these Terms.

Article 5 (Responsibilities of Users)

In addition to complying with these Terms of Use, users shall comply with the procedures and safety measures established by the Company when using the Service. If users fail to comply or are otherwise determined to be unsuitable for the operation of the Service, the Company shall: We may stop such behavior or take necessary measures such as suspension of the use of the Service, compensation for loss, and other measures, including legal measures.

Article 7 (Prohibitions)

Users shall not engage in any of the following behaviors while using the Service.

(1) Conduct that violates laws, regulations and other provisions, criminal conduct, conduct that leads to the commission of a crime (including conduct that may lead to the commission of a crime), or conduct that causes trouble to others.

(2) Acts such as fraud or other acts that lead to the commission of an offense with the purpose of obtaining an illegal benefit.

(3) Acts that infringe or result in infringement of the rights of the Company or third parties, including a wide range of intellectual property rights such as copyrights, trademarks, patents, honorary rights, privacy rights, and other legal or contractual rights.

(4) Discrimination, defamation of others, and conduct that damages the honor and reputation of others.

(5) Deliberately disseminating false information or spreading rumors.

(6) Deliberately sending the same message multiple times in order to protect one's own interests or to harm others.

(7) Acts of impersonation of the Company or a third party, or acts of willful dissemination of inaccurate information.

(8) Actions that use the Service for the purpose of proposing a personal sale or transfer, actions that are deemed to have the primary purpose of wishing to meet or interact with persons of the opposite sex, or other actions that are different from the purpose of using the Service.

(9) Offering benefits or other collaboration with anti-social forces.

(10) Religious activities or recruitment to religious organizations. Speech based on a particular religion, political party or ideology.

(11) Campaigning or similar activities, whether or not during an election period.

(12) Heterosexual relationship messages, sexual entertainment advertisements, and sales campaigns

(13) Unauthorized collection, disclosure, or provision of third party personal information, registration information, and usage history information.

(14) use, offer to use, or program harmful programs such as computer viruses through or in connection with the Service.

(15) interfering with the operation of the Company's services or the use of the Services by other users or causing any obstruction.

(16) Transmitting or writing harmful computer programs.

(19) Conduct which assists or encourages conduct falling within (1) to (18) above.

(20) Any other conduct that the Company deems inappropriate.

2. If a user is reported to have violated the previous provision, we may, without prior notice to the user, suspend the use of part or all of the services, cancel the membership, or take any action. (including but not limited to legal measures) that we deem necessary, such as demanding damages, pursuing criminal liability, and filing charges.

Article 8 (Suspension)

Under any of the following circumstances, the Company may temporarily suspend the provision of all or part of the service without the consent of the user: In this case, even if the user suffers any damage or disadvantage, the Company will not bear any compensation.

(1) System/line maintenance and updating on a regular basis or in case of emergency as deemed by the Company.

(2) When the Service is difficult to provide due to force majeure events such as lightning, fire, power outages, server attacks, etc.

(3) When, in addition to the above, unforeseen circumstances make it difficult to provide the Service.

Article 9 (Disclaimer)

The Company does not guarantee the truthfulness, accuracy, reliability, etc. of the information provided to the user through this service, and assumes no responsibility for any damage caused to the user as a result of such information.

2. The Company shall not be liable for any damages caused by a user's violation of these Terms of Use.

3. The Company shall not be liable for any defects or errors that may occur in the Services.

4. The Company shall not be liable for any damage caused by natural disasters, server downtime, viruses, force majeure, or other causes that result in the deletion or modification of data or suspension of the Service.

5. Users acknowledge that, even with current security and appropriate measures at the technical level, there are limitations to the security features of the Service and that the Company is unable to fully or completely protect the privacy and confidentiality of Users. Please use the Service on the understanding that we cannot guarantee that your personal information will be maintained.

Article 10 (Treatment of Content)

The following terms used in this clause are defined below:

"Content" means text, music, images, videos, programs, code and other information.

"Content" means Content that can be accessed through the Services.

Users are not allowed to use the Content in a manner that exceeds the natural planning of the Services (including acts such as copying, transmitting, reproducing, modifying, etc.). This does not apply if prior consent has been obtained from the Company and the right holder of the Content.

Users shall make their own judgment and take responsibility for the contents of advertisements and linked external websites.

Article 12 (Compensation to us)

Users shall not be directly liable to the Company for any damages (including in the event that the Company receives a complaint from a third party) arising from the use of the Services by Users in violation of laws and regulations or these Terms of Use. In the event that the Company indirectly suffers any damage, loss, or cost burden (including the burden of attorney's fees), the Company shall immediately compensate or indemnify the Company upon the Company's request.

Article 13 (Provision of Services, No Warranties, Changes, Termination)

The Company may publish advertisements of the Company or third parties on the Services.
We may change all or part of the Service or discontinue providing the Service at any time without prior notice to Users if we deem it necessary.

2. The Company does not warrant against any factual or legal defects in the Service (including the Content) The Company does not warrant that there are no factual or legal defects (including, but not limited to, defects, errors or mistakes, copyright infringements relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc.). The Company is not obliged to eliminate such defects and provide the Service to the User.

3. If the Company determines that the User has used the Services in violation of these Terms of Use, the Company will take such measures as the Company deems necessary and appropriate. However, the Company does not warrant to the User or any third party that the User or any other person will not violate these Terms. In addition, the Company has no obligation to the User or any third party to prevent or correct such violations.

Article 14 (Manner of notification or communication)

Notices or communications from the Company to users of the Service shall be made by posting in an appropriate place on a web site operated by the Company or by such other means as the Company deems appropriate, and may be displayed, etc., using any such means. The notice shall be deemed to have been given at the time.

Article 15 (Relationship to Individual Terms of Use)

Regarding the Service, in addition to these, if there are any documents issued or published by the Company under the names of "Terms of Use," "Guidelines," "Policies," etc. (hereinafter referred to as "Individual Terms of Use") Terms of Use. In addition to these Terms of Use, users must also use the Services in accordance with the Individual Terms of Use.

Article 17 (Applicable Law)

These Terms and other legal relations between the User and the Company shall be governed by the laws of Japan, and this Agreement, etc. shall be construed in accordance with the laws of Japan.

Article 18 (Exclusive jurisdiction)

The Tokyo District Court shall have exclusive jurisdiction in the first instance for disputes between users and the Company arising out of or in connection with the Service.
